Part A: Applicability of these Terms

The promotions and discounts are subject to Australian Consumer Law and that nothing in the terms excludes or limits the consumer rights provided under the ACL. Any changes to the Promotions and Discounts terms and conditions are updated through website updates.

These terms and conditions apply in conjunction with any other applicable terms and conditions or policies set out www.mjbale.com (online), and set out the terms on which Newbale Clothing Pty Ltd (M.J. Bale, we, us and our) offers to its customers promotions, discounts and offers, including but not limited to percentage off offers, red ticket discounts, bundle, MJB Members’ program offers, including member multi-buy offer, member spend and receive offer, coupon codes and MJB Members rewards (Promotions) as well as M.J Bale gift cards (Gift Card) and partnership reward cards (Partnership Reward) and credit notes (Credit Note) (Promotion Terms).

If you sign up to our MJB Members’ Program, obtain and or use any Gift Card, or Partnership Reward card, or Credit Note, you warrant and represent to us that you:

• Are over the age of 18 or if you are under the age of 18, you must obtain your parent or guardians’ consent; and

• Have read, understood and agree to be bound by these Promotional Terms, in conjunction with any other applicable terms and conditions or policies set out on our website.

Definitions and General Promotion Terms 

In these terms, the following terms have the meanings set out below:

• online means M.J. Bale website (www.mjbale.com);

• premium stores mean any M.J. Bale branded free-standing stores;

• department store means any Myer or David Jones concession stores;

• department online store means Myer online (www.myer.com.au) and David Jones online (www.davidjones.com);

• outlet stores mean any M.J. Bale stores in an outlet mall or outlet precinct;

• markdown refers to red ticket M.J. Bale products /styles in stores and permanent markdown online. Permanent markdown online is indicated by original pricing with a strikethrough and new pricing underneath;

• cannot be used in conjunction with any other promotion, discount or offer;

• are non-transferable and non-redeemable in cash; and

• cannot be used to purchase Gift Cards or any excluded items. 

Part B: Specific Promotional Terms

The below terms and conditions apply to the respective Promotions.  These terms are subject to change by M.J. Bale from time to time without notice.  You should always check for the current terms and conditions applicable to a Promotion at the time of the publication of the Promotion.

PART A: Applicability of these Terms.

1.     To participate in this promotion, customers must be registered members of MJ Bale. However, customers who are not yet members may sign up for membership at the time of purchase to become eligible for the Spend and Receive promotion.

2. Mechanics:

(a) Spend $250 and receive a $50 Spend and Receive MJ Bale voucher, credited to your Bale Bucks account.

3. To qualify for the Spend and Receive MJ Bale voucher, the customer must meet the required total minimum product spend amount detailed above (Minimum Spend) by using cash/card.

This offer excludes:

PART B: Terms and Conditions of Spend and Receive MJ Bale Vouchers

1.     Spend and Receive MJ Bale vouchers will be issued at checkout and automatically added to your MJB Bale Bucks Account. To view the Spend and Receive MJ Bale voucher please log in to your account.  

2.     All Spend and Receive MJ Bale vouchers issued under this promotion must be used by 11:59 PM (AEST) on 14th April 2025, after which they will automatically expire.

3.     Each Spend and Receive MJ Bale voucher issued under these terms can only be used once and if not used in full will automatically expire once part of the Spend and Receive MJ Bale voucher is used.

4.     Transactions paid fully or partially with Spend and Receive MJ Bale vouchers are non-refundable for cash and the Spend and Receive MJ Bale voucher will not be reinstated upon the return of a product, whether in-store or online except where the product is faulty or where we are required by law to accept a return, exchange or refund of the product, in which case the Spend and Receive MJ Bale voucher utilised for this transaction will be reinstated.

5.     Spend and Receive MJ Bale vouchers cannot be redeemed or exchanged for cash.

M.J. BALE Wedding Competition 2025 Terms & Conditions

Part 1

1. TERMS

1.1. These terms and conditions comprise of Part 1 which sets out important information about the promotion and Part 2 which sets out details of the prize. Parts 1 and 2 are collectively referred to as the “Conditions”. By participating in the promotion entrants agree to be bound by the Conditions. Entries must comply with the Conditions to be valid.

2. ENTRY ELIGIBILITY

2.1. Entry is open to all Australian residents and permanent citizens entrants, 18 years and older.

3. EXCLUSIONS

3.1. In addition to any exclusions set out in the “Entry Eligibility”, employees of the Promoter, its related bodies corporate and any store trading under the “M.J Bale” brand are not eligible to enter. Immediate family members of any employee mentioned in the previous sentence are also not eligible to enter.

4. PROMOTIONAL PERIOD

4.1. The promotion commences at 12:00 am (AEST) Friday 7th February 2025 and closes 11:59 pm (AEST) Monday 24 February 2025. 4. The Promotion will be open during the Promotion Period. All eligible entries must be received by the Promoter during this time. Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission by the Entrant.

5. WINNING MECHANIC

5.1. To enter the promotion, participants must complete the competition online form at https://form.typeform.com/to/OR5TOE8a and complete the required questions

6. DRAW DETAILS

6.1. All entries will be assigned a number, and the Winners will be drawn by a random electronic number generator. The prize draw will take place at M.J. Bale, Unit 24/115 – 151 Dunning Avenue, Rosebery, NSW, 2018, on Tuesday 25 February 2024, 10 am (AEST). The Winner will be notified at 12.00 pm (AEST) on the same day

7. NOTIFICATION OF DRAW RESULTS

7.1. The eligible prize winner will be notified by phone, email, and in writing on Tuesday, 25 February 2024 1.00 pm (AEST). Winner’s details (last name, first initial and postcode) will be published online at mjbale.com. Winners will also be announced online at the Promoter’s Website within 7 days of the draw, and will remain published for a minimum period of twenty-eight (28) days.

8. PRIZES

Current Information Required

8.1. The national total prize pool is valued at $3,000 AUD. The Promoter shall not be liable for any loss, damage or injury suffered (even if caused by negligence) as a result of accepting and/or using a prize, except for any liability which cannot be excluded by law.

8.2. The Promoter will not be liable for any delivery of prizes to a wrong address or account due to any error by the Winner.

8.3. The Promoter will not be liable for re-drawing or providing a replacement prize for any Prizes that are not received by the Winner due to being lost in transit, stolen or due to any failure to accept delivery by the Winner or due to any error in details provided by the Winner.

9. PRIZE DELIVERY

9.1. Prizes will be delivered to the Winners to their nominated address or email address (at the Promoter’s discretion) within twenty-eight (28) business days of the Draw / re-draw date. If the Prize contains a cash prize, it will be delivered to the Winner by bank transfer to their nominated bank account. The Promoter will pay for the delivery of the Prize to the Winner's nominated address. However, the Winner is responsible for any other costs associated its receipt of the Prize, including any taxes or transfer duties or costs.

10. FORCE MAJEURE

10.1. The Promoter shall not be liable for any failure or delay in delivering the Prize within the specified timeframe due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government restrictions, industrial disputes, supply chain disruptions, transportation delays, or any failure or delay caused by the Prize Supplier(s) ("Force Majeure Event").

10.2. In the event of a Force Majeure Event, the Promoter will use all reasonable efforts to arrange for the delivery of the Prize as soon as practicable. The winner will be notified of any expected delays and, where possible, offered an alternative prize of equal or greater value, subject to availability and at the Promoter’s sole discretion.

11. TRANSFERABILITY OF PRIZES

11.1. All prizes are not transferable or exchangeable and cannot be taken as cash.

12. UNAVAILABILITY OF PRIZES

12.1. If the prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may, but is not obliged to, substitute a prize of equal or greater value, subject to any written directions from the various lottery authorities.

13. CANCELLATION

13.1. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.

14. DECISIONS ARE FINAL

14.1. The Promoter’s determination regarding the draw is final and binding on all entrants. No correspondence will be entered into between the Promoter and entrants. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if illegitimate, forged, manipulated or tampered with in any way.

15. VERIFICATION

15.1. Prizes will only be awarded to the person named on entry, subject to their entry complying with these terms and conditions. The Promoter reserves the right to request verification of identity and residential address of winners and any other information relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who is involved in any way in interfering or tampering with the conduct of this promotion.

16. UNCLAIMED PRIZE DRAW

16.1. If the winner(s) does not redeem the prize within 7 days of being contacted, their prize will be redrawn. The unclaimed prize draw will take place at M.J. Bale, Unit 24/115 – 151 Dunning Avenue, Rosebery, NSW, 2018, on Wednesday, 4 March 2025, 12:00 pm AEST). The eligible prize winner will be notified by phone, email, and in writing Wednesday, 4 March 2025, 1:00 pm (AEST). The Winner’s details (last name, first initial and postcode) will be published online at mjbale.com, and will remain published for a minimum period of twenty-eight (28) days.

17. RELEASE

17.1. Before the prize is awarded, the winner and any other person(s) sharing the prize with the winner may be required to sign an agreement to release the Promoter from and indemnify the Promoter against any liability arising from the use or participation in the prize. Irrespective of whether an entrant signs a release, by entering in the Promotion each entrant is deemed to release the Promoter from and indemnify the Promoter against any liability, loss, cost, damage, claim, demand, proceeding or litigation of any kind relating to the use or participation in the prize.

18. EXCLUSION OF LIABILITY

18.1. The Promoter will not be liable for any late, lost or misdirected entries including due to technical disruptions, delayed or misplaced postage, network congestion or for any other reason. To the maximum extent permitted by law, the Promoter will not accept any liability for any error, omission or failure to administer this Competition.

18.2. Except for any liability that cannot be excluded by law, all Entrants release, and indemnify and hold harmless the Promoter (including its officers, employees, agents and contractors), from and against, all liability (including negligence), actions, claims, costs, losses or expenses arising out of or in connection with: any act, omission, negligence, fraud, willful misconduct or breach of these terms and conditions by the Entrant, its nominees or agents and the Entrant or Winner’s acceptance of, use of or attempted use of any prize(s) and participation in the Competition, including (but not limited to) loss of income, damage to property and personal injury whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.

18.3. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees, agents and contractors) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following:

(a) inaccurate or incorrect transcription of entry information;

(b) any technical difficulties or equipment malfunction, malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment, or software (whether or not under Promoter ’s control);

(c) the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any website;

(d) any theft, unauthorised access or third party interference;

(e) electronic or human error which may occur in the administration of the Competition;

(f) any variation in prize value as stated in the Schedule;

(g) any tax liability incurred by a Winner or Entrant;

(h) redemption or use of a prize; and

(i) any act or omission, deliberate or negligent, by the Promoter, or its employees or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a Winner and, where applicable, to any family/persons accompanying a Winner.

18.4. To the maximum extent permitted by law, the Promoter's total aggregate liability to the Entrant under or in any way connected with these terms and conditions and the Competition, or the performance or non-performance of these terms and conditions is limited to an amount equal to any amounts paid by the Entrant to the Promotor in the three (3) month period immediately preceding the date on which the relevant claim arose, which may be zero.

19. PROMOTION

19.1. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event that they are a winner in any media for an unlimited period of time and/or promoting any products manufactured, distributed and/or supplied by the Promoter. The Winner will not be entitled to any fee for such use.

20. PRIVACY

20.1. Information collected from entrants will be used in accordance with the terms of the Promoter’s Privacy Policy which can be viewed at https://www.mjbale.com/legal/privacy-policy.html Information collected as part of the promotion will be used for the purpose of conducting this promotion (which may include disclosure to listed third parties, including local lottery authorities, for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion. By entering this promotion, entrants consent to the use of their information as described and agree that the Promoter and listed 3rd Parties identified at entry point may use this information in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant. 3rd Parties privacy policies are available through their own websites.

20.2. By entering this promotion, entrants consent to the collection, use, and disclosure of their information to Newbale Clothing Pty Ltd

20.3. Each business entity will handle the entrant’s personal information in accordance with its respective privacy policy:

20.4. By entering this competition, entrants consent to the sharing of their personal information between these entities for the purposes of competition administration, lead generation, and marketing activities.

21. MAXIMUM ENTRIES

21.1. 10,000 per person.

22. 3RD PARTIES

22.1. The Prizes may contain goods or services from 3rd party brands. Unless otherwise specified, the provision, advertisement or offer of prizes from a 3rd party brand does not constitute any sponsorship, approval or endorsement of the good, service, content, policies, practices or services offered by those parties.

22.2. Where a Prize is specified to be delivered directly from the 3rd party prize supplier, as a condition of entry, the Winner agrees that its details may be provided to the 3rd party prize supplier by the Promoter on its behalf for the purpose of delivery of the Prize to the Winner.

23. INTELLECTUAL PROPERTY

23.1. By uploading, publishing, transmitting or making available any data, content or other material in connection with this Competition (Entrant Content), the Entrant agrees to grant the Promoter, its affiliates, licensees and successors a non-exclusive, royalty-free, perpetual, irrevocable, worldwide and fully sub-licensable right to use, communicate, reproduce, modify, adapt, publish, publicly perform, translate, create derivative works from, distribute and display in any form, any such content, including but not limited to text, images, videos, graphics, audio and photographs without attribution.

23.2. The Entrant warrants and represents that:

(a) it holds all the intellectual property rights to the Entrant Content;

(b) it has the authority and licence to upload, make available and licence the Entrant Content to the Promoter; and

(c) the Promoter’s use of the content will not infringe or violate any third-party rights, including but not limited to defamation, intellectual property rights, moral rights and privacy rights and will not give rise to an obligation to make any payment to a third party.

23.3. The Entrant agrees that they are solely liable for the Entrant Content and that, to the fullest extent of the law, the Promoter shall not be liable in any way for such Entrant Content.

24. SOCIAL MEDIA PLATFORM

24.1. The Competition is in no way sponsored, endorsed or administered by, or associated with www.instagram.com and its related mobile application, or any other social media platforms (Social Media Platform(s)).

24.2. The Entrant agrees that it releases the Social Media Platforms from any and all liability to the Entrant arising out of or in connection with the Competition.

24.3. The Entrant must not:

(a) harass or bully any other person, use offensive language, use language that defames the Promoter, or use language that negatively impacts or intends to negatively impact the reputation of the Promoter;

(b) use electronic programs, bots or similar technology to automatically submit entries;

(c) use multiple Social Media Platform accounts to enter the Competition; or

(d) tag other accounts owned or controlled by the Entrant to enter the Competition and agrees that it will only tag genuine friends or family in their entry

and the Promoter reserves the right to disqualify any Entrant or Entry that breaches these terms

and remove any such entries from the Competition.

25. GENERAL

25.1. These terms and conditions are governed by and will be construed under the laws of New South Wales and the parties agree to submit to the exclusive jurisdiction of the courts of New South Wales and its appellate courts.

25.2. Failure by Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

25.3. Capitalised terms used throughout these terms and conditions are defined in the Schedule unless specified otherwise.
